AR MONITORING SYSTEM LICENSE TERMS

Name of Product : Watch Catch Video Surveillance Software, hereinafter referred to as “Software”.

These license terms are an agreement between AR Monitoring System and yourself (and includes any person authorized to use this software on your behalf). Please read them. They apply to the software named above, which includes the media on which you received it, if any. The terms also apply to any AR MONITORING SYSTEM

AR MONITORING SYSTEM LICENSE TERMS

Name of Product : Watch Catch Video Surveillance Software, hereinafter referred to as “Software”.

These license terms are an agreement between AR Monitoring System and yourself (and includes any person authorized to use this software on your behalf). Please read them. They apply to the software named above, which includes the media on which you received it, if any. The terms also apply to any AR MONITORING SYSTEM

* updates,

* supplements,

* Internet-based services, and

* support services

for this software, unless other terms accompany those items. If so, those terms apply.

By using the software, you accept these terms. If you do not accept them, do not use the software.

This license is granted to you(and includes any person authorized to use this software on your behalf)and you agree and give your consent to the terms of this license herein stated, by clicking “ACCEPT” button of this software and/or by Clicking “I Agree” in the website registration page of www.watchncatch.com

If you comply with these license terms, you have the rights below.

1. INSTALLATION AND USE RIGHTS. You may install and use one copy of the software on your device.

2. ADDITIONAL LICENSING REQUIREMENTS AND/OR USE RIGHTS.

a. You shall not at any point of time claim ownership on the software.

b. Period of License. The period of license is for a period of one year subject to till the terms of license mentioned are complied and subject to the period M/s AR Monitoring System is continuing the services.

c. License Fees You agree to pay a yearly license fee, specified in the website of www.watchncatch.com for the product named above and it is your liability to renew your yearly license fee, before the expiry of the current license period, to enjoy the software and its services uninterruptedly.

d. Alert Credit To avail the services of SMS intimation and Phone intimation, you agree to maintain a positive balance in USD in your account. At the initial purchase of the license, you get an free alert credit equivalent to US$ 10. For each SMS intimation a sum of US$ 0.15 will be debited to your account and for each phone call a sum of US$ 0.50 will be debited to your account. The services of SMS intimation and Phone intimation will not be operative if the balance in your account is less than the minimum amount required for these services as outlined above. The rates of alert credit is subject to revision without any prior intimation. M/s AR Monitoring System reserves the right to revise the rates from time to time as it may deem fit.

3. SCOPE OF LICENSE. The software is licensed, not sold. This agreement only gives you some rights to use the software. AR MONITORING SYSTEM reserves all other rights. Unless applicable law gives you more rights despite this limitation, you may use the software only as expressly permitted in this agreement. In doing so, you must comply with any technical limitations in the software that only allow you to use it in certain ways. You may not

* work around any technical limitations in the software;

* reverse engineer, decompile or disassemble the software, except and only to the extent that applicable law expressly permits, despite this limitation;

* make more copies of the software than specified in this agreement or allowed by applicable law, despite this limitation;

* publish the software for others to copy;

* rent, lease or lend the software; or

* use the software for commercial software hosting services.

4. BACKUP COPY. You may make one backup copy of the software. You may use it only to reinstall the software.

5. DOCUMENTATION. Any person that has valid access to your computer or internal network may copy and use the documentation for your internal, reference purposes.

6. a. EXPORT RESTRICTIONS. The software is subject to INDIAN export laws and regulations. You must comply with all domestic and international export laws and regulations that apply to the software. These laws include restrictions on destinations, end users and end use.

6.b Usage Restrictions This software must not be used/deployed for any purpose unauthorized by the related country of deployment/use, i.e. this software cannot be deployed or used, if the features of the software and/or software are/is not permitted within the laws of the country of deployment/use. It will be the responsibility of YOURSELF to ensure that any such deployment/use of the software/features of the software doesn’t contravenes any of the laws in the software deploying country or the country in which software is used. By clicking “ACCEPT” button of the license terms, you give your unconditional consent and declaration that the software (including all its features) are legal and its use is lawful in your country of use/deployment and it will be your sole responsibility for any misstatement and wrongful/unauthorized use of the software or any of its feature.

6.c Other Restrictions The licensee or anybody claiming through him must observe :

(1) The software should not be used for any activities normally termed as unlawful in any country of usage/deployment, such as spying or any other activity of similar nature etc., unless specific permission to this respect has been obtained by the related government agencies in that country. You unconditionally agree to produce the copy of such permission in case the same is demanded by AR Monitoring System.

The license will be revoked on the first reporting of the contravention any of these clauses(6.a to 6.c) of the license.

7. SUPPORT SERVICES. We shall be extending you our full technical support and the technical functionality of the software is subject to the other technical configurations of your computer.

8. ENTIRE AGREEMENT. This agreement and the terms for supplements, updates, Internet-based services and support services that you use, are the entire agreement for the software and support services.

9. APPLICABLE LAW.

Any dispute arising out of the use of this software will be governed by the Indian Laws prevailing. All the legal jurisdiction fall within DURG(INDIA) jurisdiction.

10. LEGAL EFFECT. This agreement describes certain legal rights. You may have other rights under the laws of your country. You may also have rights with respect to the party from whom you acquired the software. This agreement does not change your rights under the laws of your country if the laws of your country do not permit it to do so.

11. DISCLAIMER OF WARRANTY. The software is licensed "as-is." You bear the risk of using it. AR Monitoring System gives no express warranties, guarantees or conditions.

12. LIMITATION ON AND EXCLUSION OF REMEDIES AND DAMAGES. You cannot recover, under any circumstances, from AR MONITORING SYSTEM any damages, including consequential, lost profits, special, indirect or incidental damages.

This limitation applies to

* anything related to the software, services, content (including code) on third party Internet sites, or third party programs; and

* claims for breach of contract, breach of warranty, guarantee or condition, strict liability, negligence, or other tort to the extent permitted by applicable law.

It also applies even if AR MONITORING SYSTEM knew or should have known about the possibility of the damages.

You fully understand and agrees that the services of SMS intimation and phone intimation are OPERATOR DEPENDENT and AR MONITORING SYSTEM is not responsible for any late notifications of any event or not notifying any event. No losses or damages or any amount whatever it may be, can be claimed against AR MONITORING SYSTEM for any failure in making the intimations and/or any other services outlined in the software/website www.watchncatch.com .

13. Revocation of License :License will be revoked immediately on reporting of any contravention of any of the clause of this license agreement.

Further, if any conditions of the license is contravened, including clause (6.a,6.b & 6.c)) above, the license stands cancelled with immediate effect.

14. You doesn’t have any ownership rights of the software and neither they have any reselling rights of the software.

15. M/s AR Monitoring System, reserves the right to deactivate the software if the license is revoked due to contravention of any of the clauses of this agreement.

16. M/s AR Monitoring System is not responsible for any hardware functionality installed in your system, which is not compatible with the software.

17. You understand that M/s AR Monitoring System will be collecting various IDs of your hardware components of your computer, for proper functioning of the software. By clicking “ACCEPT” button of this software and/or by Clicking “I Agree” in the website registration page of www.watchncatch.com , you give your unconditional consent to and authorize M/s AR Monitoring System, to collect the hardware IDs of components of your Computer. These IDs will not be exposed to any third party unless required by any government agency under appropriate law of any country.
